About SBA 8(a) Sole Source

The Small Business Administration (SBA) 8(a) certification program is designed to help small, disadvantaged businesses compete for federal contracts. 8(a) certified firms may receive sole-source contracts up to $4.4 million and partner with other business owners to bid on contracts. Allied Mission Group’s 8(a) status can facilitate awards quickly, reducing time spent on RFP development and reviewing contractor responses. The 8(a) program also helps agencies fulfill their commitment to teaming with small businesses.

Section 8(a) of the Small Business Act (15 U.S.C. 637(a)) authorizes the Small Business Administration (SBA) to enter contracts with federal agencies and subcontract the performance of those contracts to eligible small businesses. This program is known as the 8(a) Business Development Program, or simply the 8(a) program. Small businesses accepted into the program are called participants, and those performing on federal contracts or orders set aside for the 8(a) program are referred to as 8(a) contractors. Contracts may be awarded to the SBA for execution by qualified 8(a) participants either on a sole-source or competitive basis. Acting under the program’s authority, the SBA certifies to an agency that it is competent and responsible for fulfilling a particular contract.

The contracting officer may then award the contract to the SBA under mutually agreed-upon terms and conditions. Before doing so, the contracting officer must follow the procedures outlined in FAR 19.203. For acquisitions above the simplified acquisition threshold, the officer must first consider 8(a) set-asides or sole-source awards before turning to other small business set-aside options. When the SBA has delegated its 8(a)-contract execution authority to an agency, the contracting officer must consult the agency’s internal policies or supplemental guidance to ensure proper compliance.
